Mediation - where both parties try to resolve their dispute with the help of a neutral third party - often costs less and takes less time than a court battle. Unlike the court system, mediation can also give each party a particular result that may mean more to them than money. Mediation is effective in many conflicts, including:
- Family matters, including divorce mediation, child custody and visitation issues, child support and alimony (spousal support)
- Employment disputes, such as wrongful termination, discrimination, harassment, promotions and layoffs
- Neighborhood conflicts over noise, construction, trespassing, rights-of-way and easements

In many situations, the Texas court systems are not only encouraging parties to resolve their disputes through mediation - they are making it difficult to do anything else. In some counties, mediation is required in any case where a party requests a jury trial. And in Travis County, attorneys who insist on bringing their cases to jury trial must comply with as many as 13 deadlines imposed by the court in the 30 days before trial starts.
